TERMS AND CONDITIONS FOR DAYCARE/GROOMING/BOARDING/TRAINING AND WAIVER OF LIABILITY

The provider of services herein is Pooches, LLC, an Oklahoma Limited Liability Company, doing business as "Pooches" (hereafter referred to as "Pooches"). The term "owner" is the person who owns the dog or dogs left in the care of Pooches. In addition, "owner" may be the agent of the person who owns such dog or dogs if such person has authorization from the owner to leave the dog or dogs in the care of Pooches. Personnel at Pooches shall have sole discretion to decide what constitutes sufficient authorization for such.

Owner agrees to allow Pooches to use owner's dog's name and any images of the dog taken while at Pooches in any form or format, for use in any media, advertisements, and promotional material.

Pooches will provide due and reasonable care and will keep the premises sanitary and properly enclosed. The dog(s) will be fed properly and regularly, cared for humanely, and housed in clean, safe quarters.

Owner agrees that if a dog is presented with fleas and/or ticks, it will be bathed and treated at the owner's expense.

Owner agrees that Pooches shall not be responsible for any loss or damage to personal property belonging to owner. This includes collars, leashes, dog beds, dog bowls, dog toys, blankets, towels, crates and any other item that owner may leave at Pooches.

Owner agrees that all dogs are boarded, trained, groomed or otherwise cared for by Pooches without liability on the part of Pooches (including the owners and employees of Pooches).

Owner understands and accepts the possibility that during participation at Pooches-to include daycare, boarding, training, and grooming-injuries can occur including, but not limited to, bites, scratches, eye injuries, and pulled or strained muscles.

Owner understands that not all pets will integrate into a group play setting and that if the dog(s) displays any aggressive tendencies (as determined in the sole discretion of any employee or owner of Pooches), it will no longer be able to participate in daycare group play, but will still be eligible for day boarding, overnight boarding, grooming, and training services. Pooches does have the right to refuse services to any dog deemed by Pooches staff to be overly aggressive toward people and/or dogs.

The owner's dog(s) will not be taken off the premises except by consent of the owner, or in the event of a medical emergency. If the dog becomes ill or needs medical attention while in the care of Pooches, the owner shall be notified immediately. If the owner cannot be reached or does not immediately inform regarding measures to be taken, or if the state of the pet's health reasonably demands immediate action, Pooches has the right to call a veterinarian as designated by the owner, or to call an emergency veterinarian of Pooches' choice, or to take the dog to said veterinarian in either case. Further, Pooches may administer medication or give other advisable attention, within the discretion and judgment of any of its employees or owners. Any expenses incurred shall be paid promptly by the owner of the dog.

Charges for daycare, boarding, grooming, training, medication, special diet, or veterinary service are due at the time of service or upon the dog's departure. If a dog is not picked up within ten days after the scheduled departure date/time, and the owner does not contact Pooches within that time to extend boarding or make arrangements for the dog, Pooches reserves the right to place the dog in an appropriate home or animal shelter. Notice in writing of such placement shall be mailed by registered mail to the owner of the dog at the address provided by the owner not less than ten days prior to the date of placement and no further notice shall be deemed necessary.

Owner's Acceptance and Acknowledgement of Risk of Participation at Pooches: I fully understand that there are inherent and potential risks involved with interactions between humans and dogs, as well as between dogs and other dogs which may result in property damage or bodily injury including, but not limited to permanent disability, sickness or death to human or dog. I agree there may be other risks not known to me at this time or readily foreseeable at this time (collectively known as "risks"). I accept and assume responsibility for all risks, without limitation, and including but not limited to, all losses, costs and damages incurred as a result of my or my dog's participation at Pooches, to include daycare, group play, boarding, training, and/or grooming. I accept full responsibility for any and all veterinarian expenses incurred on behalf of my dog. I understand that sickness is defined to include any illness including, but not limited to, canine cough/kennel cough/Bordetella, any other form of contagious illness, or illness related to diet change.

Waiver of liability: I hereby agree to hold harmless Pooches and its owners and employees for any and all loss or damage to my dog(s). Such loss or damage shall include, but is not limited to, disease, death, injury, running away, theft, fire, and natural disaster. Further, I agree to indemnify and hold harmless Pooches and its owners and employees for any and all loss or damage caused by owner's dog(s) while at Pooches. Such shall include, but is not limited to injury to persons, injury to other dogs, and injury to property resulting from my or my dog's participation at Pooches. I agree that this release shall be binding on me and my successors, heirs, legal representatives and assigns. I also expressly and forever release Pooches from any duty to protect me or my dog(s) from injury of any kind and agree that even if Pooches chooses to implement safety precautions, such actions shall not alter the fact that I have released Pooches from any duty to protect me or my dog(s).

Costs of Action: I represent that I am the legal owner of this dog and/or authorized to make decisions for this dog, that I have made full disclosure of any medical conditions existing for this dog and that I have read, understand and accept the terms and conditions stated in this agreement and acknowledge that this agreement shall be effective and binding upon the parties, and understand that I have signed it freely and voluntarily, and intend it to be a complete and unconditional release of all liability to the greatest extent permitted by law.
